Janusz Walus Parole.
There is so much emotional uproar about our Constitutional Court ruling that Walus be released on parole.
Understand that Walus qualified for release on parole over a decade ago and, unlike the situation for other murderers, he has been consistently denied parole.
The reason for this denial is obvious and comes up in all the mouthings of protestation.
It is because he killed Chris Hani, a struggle hero.
So PLEASE look at this image and ask yourself if the murderers depicted should be treated differently as regards parole?
The answer is NO ... NO ... NO ...
and the reason is that no human life can be classified as more important or valuable than any other human life.
Judges act dispassionately. In terms of their oath of office they act "without fear, favour or prejudice".
They are absolutely constrained to uphold the Doctrine of Equality Under the Law.
In terms thereof there is simply no room for making distinctions as regards parole that are dependent on the status of the victim.
They are upholding the sacred principle of "Equality Under Law".
In terms of this Doctrine that the last World War and the Holocaust induced our species to adopt ....
humans are equal and not on George Orwell's Animal Farm, where some are "more equal than others".
Before that the almost universal culture was "Might is Right". . which explains colonialism and Mfecane.
So, think it through. If Walus had killed you, he would have been granted parole a long time ago.
All the emotive frothing at the mouth, bla bla bla and other protestations ignore the reality that no human life can be regarded as more valuable than that of another.
A Judge will discriminate on the grounds of "moral blameworthiness". So a murder is more heinous if the killer tortures a baby to death as opposed to shooting you in the tavern.
However moral blameworthiness cannot increase on account of the status of the victim.

Note:-
that personally I believe that where there is no doubt about a cold-blooded murder, the convict should be executed in public in the same manner that he/she killed the victim.

PS: last night I watched and heard none other than Advocate Muzi Sikhakhane SC spewing out so much convoluted nonsense about our Judges and this issue.
